Terms of Use
These terms govern your use of the WakeLab app for iPhone ("WakeLab", "the app"), operated by Tobias Kern, Switzerland ("we", "us"). By downloading or using the app you agree to them. If you do not agree, do not use the app.
Apple's terms also apply
You get WakeLab through the Apple App Store, so Apple's Standard End User License Agreement applies too. If these terms and Apple's conflict, Apple's prevail on the points it covers. Apple is not responsible for the app, its maintenance or support, and is a third-party beneficiary of these terms.
What WakeLab is
WakeLab analyzes wakesurf video on your device and shows movement metrics, scores and feedback. It is a training aid. It is not a coach, a judge, or a medical or safety product.
Wakesurfing is risky, use your own judgment
- Wakesurfing and other water sports carry a risk of injury and death. You take part at your own risk.
- Scores, metrics and feedback are estimates from video and can be wrong. Do not rely on them for safety decisions, and do not attempt anything beyond your ability because of what the app shows.
- Do not use the app, including Live view, in a way that distracts the driver, the spotter or you from operating the boat and watching the water. Follow the local boating rules.
WakeLab Pro subscription
- WakeLab is free with a limited number of analyses per month. WakeLab Pro removes that limit and unlocks the features listed on the in-app paywall.
- Pro is an auto-renewing subscription. Price and billing period are shown in the app before you buy. Payment is charged to your Apple ID at confirmation of purchase.
- It renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it under iOS Settings → your name → Subscriptions, and cancellation takes effect at the end of the paid period.
- Billing, refunds and any free-trial terms are handled by Apple under its policies. We cannot issue refunds ourselves, so please request them at reportaproblem.apple.com.
- Prices may change. If a change affects an existing subscription, Apple will notify you and, where required, ask for your consent.
Your content
Your videos, photos and runs remain yours. We do not receive them, and you grant us no license to them. You are responsible for having the right to record and analyze the footage you use, including people who appear in it.
Acceptable use
You agree not to reverse engineer, decompile or copy the app except where the law allows it, not to remove protection or licensing checks, and not to use the app unlawfully or to harm others.
Our rights
The app, its design, name, models and content are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, under Apple's usage rules.
Availability and changes
We may update, change or discontinue features, and will try to keep the app running but do not guarantee uninterrupted or error-free operation. iCloud sync depends on Apple's services and your iCloud account.
Warranty and liability
The app is provided "as is" and "as available". To the extent the law allows, we exclude warranties and are not liable for indirect or consequential loss, or for injury, damage or loss resulting from how you use the app or from reliance on its analysis. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or your mandatory consumer rights.
Governing law
These terms are governed by Swiss law, excluding its conflict-of-laws rules. If you are a consumer, mandatory consumer-protection rules of the country where you live remain unaffected, and you may also bring claims in the courts there.
Changes to these terms
We may update these terms. The date above shows the latest version. If you keep using the app after a change, you accept the updated terms.
